The Timișoara Court of Appeal ruled that the sending of messages on Facebook with insults and death threats is likely to create a fear of its recipient, being met the constituent elements of the crime of threat (art. 206 para. 1 C. pen.). In this case, the court applied to the defendant a criminal fine of 8000 lei with effective execution for the act of the defendant who on 07.06.2021, around 17:30, threatened, through voice messages sent on his mobile phone, the injured person #### # with death, provoking a state of fear, meeting the constitutive content of the threatening crime (art. 206 para. 1 of the Penal Code, with the application of art. 41 para. 1 of the Penal Code).
